First Time In The Country The Implementation Of The Telegraph Act In Telangana


The phone tapping affair is creating a stir in Telangana. The Hyderabad police are working on a detour in connection with this case. Already.. many senior police officers have been arrested.. shocking things are being revealed in the investigation. In this order, another sensation has been registered in the case of phone tampering. Police officials filed a memo in the Nampally court attaching the Telegraph Act-1885 in the case. However, for the first time in the country, a case has been registered under the Telegraph Act-1885 in Telangana. Actually.. What is the Telegraph Act?.. What evidence is required for the implementation of this Act?.. What does the actual Act say?.. Let's take a look at the points.

Actually.. phone tapping is illegal. However, this is not the case in all cases, as the government has a specific procedure for phone tapping, justifiable reasons, and only in special circumstances. On the request of superiors.. the concerned service provider will provide this opportunity subject to law. Calls can be intercepted by the State Government or the Central Government to prevent any crime for the purpose of safeguarding the sovereignty, integrity, peace and security of the country, maintaining good relations with foreign countries. Research agencies like Intelligence Bureau, CBI, ED, Narcotics Control Bureau, Central Bureau of Direct Taxes, Directorate of Revenue Intelligence, which are usually under the jurisdiction of the Centre, do phone tapping.

According to Section-5(2) of the Indian Telegraph Act-1885, states and the central government have the possibility of tapping in many aspects. However.. regarding that the respective governments have to take many permissions. Union Home Ministry plays a vital role in it. It is a big process. Section 69 of the Information Technology Act-2000 also deals with tapping. The permission of Union Home Secretary and State Home Secretary is required to record or intercept calls. There is a possibility that private individuals and private organizations can also develop special software and engage in phone tapping. Doing so would violate the right to privacy of the citizen. That is why the Indian Telegraph Act-1885 was created during the British era with the aim of preventing such situations. According to Section 26 (b) of the Indian Telegraph Act, a conviction for phone tapping carries a maximum jail term of up to three years.

In general, the implementation of the Telegraph Act, which was not implemented even during the Emergency imposed by Indira Gandhi, in the matter of phone tapping is creating a stir. The registration of a case under the Telegraph Act for the first time in Telangana has become a sensation.
